Returns and Refunds

Please note that if you use our 30-day evaluation period sensibly, you will not need this facility.

You have the 'Right to Cancel' under the UK Distance Selling Regulations. We recognise this as a right of all our customers, whether they reside in the UK or not. Customers who wish to exercise this right must do so within 7 days of receiving our email that delivers the licence to them.

If you decide, within 7 days, that you do not want PenDrawDev

1. You send us the following Statement of Return (you are entitled to use other words, but we prefer this wording, which you can copy-and-paste from here to save you time and trouble):
   
   I/We wish to exercise our Right to Cancel, and wish to activate the PenDrawDev Returns Process for licence No ...... . I/We wish to be refunded. Within 7 days of notification from PenDraw Ltd that the PenDrawDev Returns Process is activated a) I/We will have removed it from all our computers for which that licence was purchased, b) I/We will have destroyed all copies of the licence. I/We have not provided are not providing and will not provide any copy of the licence to any third party. We are sending this Statement of Return by email, fax, letter (delete which does not apply).
2. You send that Statement of Return. You may send it via email, or fax, or by letter. The time of cancellation is taken as the time that the email/fax arrives, or the letter was posted. If you send via email, we require that you also send by letter. The reason is that email is not secure enough to be absolutely sure that the message is authentically from you; but it does provide you with a way to record your decision within the 7 days: once we have your email, it does not matter if the written Statement of Return is a little delayed in the post. (If we accepted an email, but it was from a third party who was impersonating you, it could inconvenience you at a later date if you wanted to upgrade your licence but our records showed that you did not have one. You see, there is no way of knowing precisely who an email came from, thus impersonation is a real – if small – risk).
3. We reply to your first communication on our first working day after it arrives, confirming receipt. Provided it does arrive within the 7 days, we also confirm to you that the PenDrawDev Returns Process is activated for the licence in question. If arrives after the end of the 7 day period, we inform you that the the PenDrawDev Returns Process is not activated (though see Discretion, below). For this stage of the process, the critical time is the time the first communication arrives or was posted, of course, not the time when we read it.
4. Provided that we have notified you that the PenDrawDev Returns Process is activated, we refund your payment and record that your licence is invalid. We refund promptly. If you are sending by email and letter, we wait for your letter before refunding and recording that your licence is invalid.
5. Provided that we have notified you that the PenDrawDev Returns Process is activated, you remove PenDrawDev from every computer for which you had the Returned licence, and you destroy all copies of the licence.

After 7 days, we do not accept returns. We believe that 30 days is sufficient time for a) serious evaluation, and b) a sound decision process, on your part. We believe that purchasers have the opportunity to make an informed choice, and hence should have no reason to change their mind afterwards.

We reserve the right to accept the Return and refund you, even if your Statement of Return arrives outside the 7 day period, but it is at our sole discretion. This discretion is primarily intended for us to make reasonable allowance for national holidays. Hence we do not use it beyond 14 days as an absolute maximum.
